1. General Terms and Conditions

1.1. These terms and conditions (“T&C” or “Terms”) govern the terms of use of the features of Maya In-app Tap-to-Pay (“Maya Tap-to-Pay”) in the Maya App that enable you to perform card-present transactions at Near Field Communication (NFC) -enabled point-of-sale terminals using your mobile device, wherein payment credentials are securely tokenized and transmitted without requiring you to physically present your The General Terms and Conditions (GT&Cs) of Maya is accessible through this link: https://www.maya.ph/terms-and-conditions are deemed incorporated into these T&C. In case of conflict or inconsistency between the GT&Cs and these T&C, there terms of these T&C shall prevail.

1.2. The Maya Bank Credit Card Terms and Conditions (the “Credit Card T&Cs”), as may be amended from time to time and accessible via https://mayabank.ph/creditcard/terms-and-conditions/ are likewise hereby incorporated by reference into these T&C. All provisions of the Credit Card T&Cs shall apply to transactions made using the Maya Tap-to-Pay feature to the extent applicable and not inconsistent with this Tap-to-Pay T&C. In case of conflict or inconsistency between the Credit Card T&Cs and these Tap-to-Pay T&Cs, the provisions of this T&C shall prevail with respect to the use of the Maya Tap-to-Pay feature.

1.3. Under this T&C, the terms “Maya”, “we”, “us”, and “our” refer to Maya Philippines, together with its employees, directors, affiliates, successors and assigns. Maya Philippines, Inc. is an electronic money issuer, operator of payment systems and virtual asset service provider, duly-licensed by the Bangko Sentral ng Pilipinas (BSP).

1.4. The terms “you” and “your” refer to users of the Tap-to-Pay or Service, as Account Holders, Cardholders, Senders, Recipients, and other applicable users of the Service.

1.5. These T&C shall be effective, valid, and binding from the time that you signify your agreement to these Terms and will be in full force and effect up to the time that it is terminated by you or us, save for some provisions which shall remain effective after termination, as stated in this T&C, under any law, rule, or regulation.

2. Definition of Terms

 2.1. Affiliates – refer to any person or entity controlled by or under common control with another For purposes of the Terms, any of the entities under the MVP Group of Companies, including but not limited to Maya Bank. Inc. (“Maya Bank”), PLDT, Inc., Metro Pacific Investments Corporation, Smart Communications, Inc., The Manila Electric Company, Maynilad Water Services, Inc., Metro Pacific Tollways Corporation, and MediaǪuest Holdings, Inc., shall be considered as Affiliates of Maya Bank.

2.2. Maya Account Holder – refers to an individual who uses the services of Maya and Maya Bank and whose name appears on the online form, or signed enrollment form or application form, or the Card, as may be applicable. Refers also to the Principal Account Holder.

2.3 Maya App - refers to the mobile application that serves as the interface between the Maya Account Holder, whose terms of use shall be in accordance with the Terms and Conditions (refer to https://maya.ph/terms-and-conditions) and User’s Guide (refer to https://www.maya.ph/user-guide) found in the said Maya App.

2.4. Maya Card “Card” – refers to physical or virtual card representation, offered by Maya, which you can use to withdraw cash or purchase goods and/or services, whose terms of use shall be in accordance with the Terms and Conditions of the Maya Card.

2.5. Maya In-app – made or available from within a Maya App on a mobile device, without the need to visit a separate online site.

2.6. Maya in-app Tap-to-Pay (“Maya Tap-to-Pay”) – refers to contactless payment feature in the Maya app that enables You to perform card-present transactions at Near Field Communication (NFC) -enabled point-of-sale (POS) terminals using your mobile device, wherein payment credentials are securely tokenized and transmitted without requiring you to physically present your Card.

2.7. Merchant - refers to the business establishment we have accredited to accept your Card as a mode of payment for your purchase of goods and/or It shall also refer to the Merchant’s stockholders, officers, managers, employees, and agents.

2.8. Near Field Communication (NFC) Point of Sale (POS) refers to a payment system that uses NFC technology to enable contactless transactions between your device (such as a smartphone, smartwatch, or NFC-enabled card) and a merchant’s POS terminal). As contactless payment, there is no need to swipe or insert your Card for your payment transactions.

2.9. Service – refers to the Maya Tap-to-Pay feature as governed by this T&C.

3. Terms of Use

To use the Maya Tap-to-Pay feature, you must be a verified Maya Account Holder and must: (i) have an NFC-enabled mobile phone; (ii) set Maya as the default contactless payment application on your mobile device; and, (iii) activate the Maya Tap-to-Pay feature of your Card in the Maya App. Once enabled, you may use your mobile device to conveniently pay for goods and/or services at NFC-enabled POS terminals by simply tapping Your mobile phone to complete the transaction without requiring you to physically present your Card. Transactions made through Maya Tap-to-Pay shall be processed in the same manner as transactions made with Your physical Card.

4. Tap-to-Pay Authorizations

By using the Maya Tap-to-Pay feature, you authorize Maya to process transactions initiated from your Card through such contactless payment method. You acknowledge and agree that any transaction made through Maya Tap-to-Pay shall be treated as if made with your physical Card and shall be valid, binding, and payable by you. You are responsible for managing and reviewing your NFC transactions to ensure they remain within your Card limits. You acknowledge that exceeding such limits may result in declined transactions, temporary account suspension, or additional verification requirements. Maya shall not be liable for any unauthorized, failed, or incomplete transactions resulting from your use of Maya Tap-to-Pay, unless such issues are directly attributable to Maya Bank’s gross negligence or willful misconduct.

5. Security

Once you activate the Maya Tap-to-Pay feature of your Card, you are solely responsible for securing your mobile device. This includes enabling appropriate security measures such as PIN, biometrics, facial recognition, password, or any other available authentication feature to prevent unauthorized access and use. Maya shall not be liable for any unauthorized transactions or losses resulting from your failure to maintain the security and confidentiality of your mobile device or Card information. Maya shall not be liable for any loss, damage, unauthorized transaction, or other consequence arising from such storage or use. The use of Tap-to-Pay through any third-party providers shall be governed by this T&C and that of the third-party providers. You agree to hold MAYA free and harmless from any claims, damages, or liabilities arising out of any unauthorized use of Maya Tap-to-Pay, or third-party platforms due to your own negligence or mismanagement of device security, or failure to comply with the provisions of these T&C.

6. Limitation of Liability

6.1. To the fullest extent permitted by applicable law, Maya shall not be liable for any loss, damage, or liability of any kind incurred by the Account Holder arising from or in connection with the use of the Maya Tap-to-Pay feature, including but not limited to:

  • Unauthorized transactions resulting from the loss, theft, or misuse of the Account Holder’s mobile device;
  • Failure, malfunction, or unavailability of any contactless payment terminal, network, or system;
  • Errors or delays in processing transactions due to technical issues, force majeure, or third-party service providers;
  • Any dispute between the Account Holder and a Merchant, including issues related to the quality, safety, legality, or delivery of goods or services purchased using the Maya Tap-to-Pay feature.

6.2. Maya does not warrant that the Maya Tap-to-Pay feature will be uninterrupted, error-free, or compatible with all devices or You acknowledge and agree that the Maya Tap-to-Pay is for your own convenience, however, the use thereof is not without risks. Except if Maya is shown to have been grossly negligent, you shall borne any risks relating to your use of the Tap-to-Pay feature.

7. Data Privacy Clause

7.1. You allow Maya to disclose Your information to acquirers, credit card network or association, collection agencies, counsels, credit bureaus, Affiliates, or other agents or partners of Maya to carry-out all necessary, related, or other legitimate transactions pertinent to Your use of the Card or other relevant Maya payment platform.

7.2. You authorize Maya, Affiliates, third-party service providers, and its official partners to collect, hold, use, and process the personal information that You have provided directly or indirectly in our data collection touchpoints relevant to the respective purposes furnished to You in our privacy With Your active use of our products and services, You hereby expressly agree to the Data Privacy Statement of Maya found in https://www.maya.ph/privacy and the Data Privacy Statement of Maya Bank found in http://www.mayabank.ph/privacy

8. Separability Clause

Should any term or condition in this Agreement be rendered void, illegal or unenforceable in any respect under any law, the validity, legality and enforceability of the remaining terms and conditions shall not be affected or impaired thereby.

9. Amendments

Maya may amend, revise or modify this T&C effective after 60 days from notice to you. You agree that for purposes of this T&C, publication of the amended T&C in Maya’s website shall be considered as sufficient notice. You may regularly check any amendments to this T&C at www.maya.com/terms-and-conditions. Your continued use of the Maya Service after any revisions constitutes acceptance of the amended T&C. Failure to notify Maya of your intention to terminate your account shall be construed as acceptance of the amended T&C.

10. Support

At Maya, we consider our customer’s financial questions, needs and feedback as very important. If you have any concerns about a procedure or have encountered a problem with our service, we will do our best to address it within 15 days. Should your concern require more time to be resolved, we will update you every step of the way.
