1. General Terms and Conditions

1.1. These terms and conditions (“T&C”) govern the terms under which You will avail of Maya XP or the “Program”. By accessing, registering or using the Service, you agree to be bound by the terms of this T&C. The General Terms and Conditions (GT&Cs) of Maya Philippines and Maya Bank Inc. accessible through these links https://www.maya.ph/terms-and-conditions and  https://mayabank.ph/terms-conditions/, respectively, are deemed incorporated into these T&C. In case of conflict or inconsistency between the GT&Cs and these T&C, the terms of these T&C shall prevail.

1.2. Under these T&C, the terms “Maya Philippines”, “Maya Bank”, “We”, “Us”, and “Our” refer to Maya Philippines, Inc. and Maya Bank, Inc., (Collectively, “Maya”) together with their employees, directors, affiliates, successors, service providers, agents, and assigns. Maya Philippines, Inc. is a Filipino remittance company, electronic money issuer, operator of payment systems and virtual asset service provider, duly licensed by the Bangko Sentral ng Pilipinas (BSP). Maya Bank is a digital bank duly licensed by the BSP.

1.3. The terms “You” and “Your” refers to the applicant and holder of the registered account holder or the Customer and the Cardholder, if any.

1.4. These T&C shall be effective, valid, and binding from the time that You signify Your agreement to these T&C and will be in full force and effect up to the time that this or Your account is terminated by You or Us, save for some provisions which shall remain effective after termination, as stated in these T&C, or under any laws, rules, or regulations.

1.5. All the headings in these T&C are for reference and/or convenience only. Our respective rights and obligations are contained in the terms provided in these T&C.

2. Definition of Terms

2.1. Affiliates – refer to any person or entity controlled by or under common control with another person. For purposes of the Terms, any of the entities under the MVP Group of Companies, including but not limited to PLDT, Inc., Metro Pacific Investments Corporation, Smart Communications, Inc., The Manila Electric Company, Maynilad Water Services, Inc., Metro Pacific Tollways Corporation, and MediaQuest Holdings, Inc., shall be considered as Affiliates of Maya Philippines and Maya Bank.

2.2. Maya XP Program (“Program”) – Refers to the program offered to customers with the numerical value shown to the customers relative to the total numerical value or incremental numerical value gained or lost by a user relative to their Level

2.3. Maya Activity (“Activity”) – Refers to all information recorded by Maya as a result of a Customers usage of the services and platforms. Including but not limited to financial and non-financial actions that users perform within the Maya app and cards, information provided based as part of the Customer’s profile, and or any additional information provided by the user.

2.4. Experience Points (“XP”) – Refers to the numerical value of points given to a customer as a result of the Maya Activity of the Customer.

2.5. Level – Represents Your current rank or status within the Maya XP program, determined by the total XP you have accumulated. As You progress through different levels, You unlock new rewards and privileges.

2.6. Benefits – The exclusive rewards, features, or perks You receive as part of Your participation in the Maya XP program. The benefits issued to You may change based on Your Level.

2.7. Raise My XP – Refers to the actions or activities You can complete to increase Your XP and advance to higher Levels within the program.

2.8. Promotion – Refers to the event wherein a customer moves to a higher Level than their current standing.

2.9. Demotion – Refers to the event wherein a customer moves to a lower Level than their current standing.

2.10. Qualifying Action – Specific tasks, transactions, or behaviors recognized by Maya XP that earn XP which help build Your score and unlock additional benefits.

2.11. Merchant – refers to the business establishment we have accredited to accept Your Card as a mode of payment for Your purchase of goods and/or services. It shall also refer to the Merchant’s stockholders, officers, managers, employees, and agents.

2.12. Maya App – refers to the mobile application that serves as the interface between You and Maya, which terms of use shall be in accordance with the Terms and Conditions and User’s Guide found in the said Maya App or Maya website.

2.13. Maya Wallet – refers to Your e-Wallet in the consumer app of Maya Philippines, Inc.

2.14. Maya Credit Card (“Card”) – refers to the physical or virtual card representation, offered by Maya Bank, which You can use to withdraw cash or purchase goods and/or services on credit whether directly from our accredited Merchants or our credit card network provider- accredited Merchants. Unless otherwise stated, any reference to the Card shall be deemed to include its Supplementary Card.

2.15. Maya Easy Credit – refers to a credit facility offered within the Maya App that provides users with quick and convenient access to short-term credit, subject to approval and the applicable terms and conditions.

2.16. Maya Personal Loans – refers to personal loan products made available through the Maya App, granting qualified users access to funds that may be used for personal needs, in accordance with Maya’s lending policies and procedures.

2.17. Partner Channel – refers to the employer, enterprise, or business, in partnership agreement with Maya, authorized to collect application inquiries and requests related to the Program from their customers or employees who have provided consent to share their personal data with Maya through Partner Channel and to transfer, process, store such personal data for purposes of the issuance or maintenance of the Card; and to give effect to these T&C.

2.18. KYC or Know-Your-Customer – refers to the process of identifying and verifying the true and full identity of customers. The term is also used to refer to the anti-money laundering regulations which governs these activities.

3. Eligibility and Participation

3.1. Customers are automatically enrolled in the Program upon acceptance of these terms, at which point they are assigned a Level and XP. Non-participation in the Program will not affect their ability to use core Maya.

3.2. Customers must complete their document submission and upgrade their accounts to become eligible to avail or redeem any Benefit associated to the Program.

3.3. Non-Payment or defaulting in Maya Easy Credit, Maya Personal Loans, Maya Credit Cards, or any loan product will remove Your eligibility to participate in the Program and redeem any Benefits until such a time that You settle any amount due as indicated within the Maya app.

3.4. Inorganic customer behavior and non-individual customer usage such as corporate accounts and accounts used for business purposes use may be disqualified.

3.5. Customers suspected of fraudulent or abusive activity may be disqualified from any or all Benefits issued to them. In case of disputes, Maya’s decision shall prevail.

3.6. Maya reserves the right to disqualify any customer from the Program in accordance with these terms and applicable regulations. Maya will review reinstatement requests at its discretion and communicate outcomes to the customer.

4. Mechanics

4.1. Maya XP will use a proprietary data model to determine a customer’s Level and total numeric value. This numeric value may increase and decrease based on several factors considered in the model.

4.2. The Customer will be shown their Level and XP upon accessing the app. Maya has the discretion to increase or decrease the Customer’s XP based on the established criteria.

4.3. Accumulation of XP may lead to a Promotion of the customer’s Level, and reduction of a customer’s XP may also result in a Demotion of the customer’s Level.

4.4. Customers’ Maya XP will be influenced by the various actions including but not limited to Financial transactions related to payments, transfers, loans, deposits and Non-financial actions related to completing their profile and usage of the app.

4.5. Customers’ XP may be augmented by several behavioral indicators such as but not limited to their transaction frequency, network of interactions, and other data points provided by the customer.

4.6. Maya may introduce additional mechanisms or conditions that may augment a Customer’s XP at any time without prior notice.

4.7. Customers XP may increase or decrease in relation to their activity. Maya is not obligated to provide further information on how the customer’s XP was derived.

4.8. Eligibility for each individual Benefit is subject to the Customer’s eligibility for the specific Qualifying Action that the benefit is associated with.

4.9. Maya XP is not equivalent to a monetary value and cannot be redeemed, traded, or sold for any reason whatsoever.

5. Levels and Benefit

5.1. Levels are a representation of Your current rank or status within the Maya XP program as determined by the total XP accumulated.

5.2. The Customer’s Level will grant customers eligibility to specific benefits as shown in the Maya XP page in the Maya app and described in this Section 5. Benefits are subject to individual product’s terms & conditions.

5.3. A Customer’s eligibility to benefits will be tied to a the Customer’s Level at the time of redemption. Changes to the Customer’s Level may modify their eligibility to the Benefits at any point in time.

5.4. Customer shall be notified through the Maya App in case of promotion or demotion of their Level based on their activity.

5.5. Your Level may be used by Maya to provide various benefits and personalized product offerings. Maya is not obligated to provide further information to the Customer on the how or why they were given this offering.

5.6. Your Level may be used by Maya to offer personalized experiences across the Maya app, website, and other communications channels.

5.7. The Benefits associated to Your Level and available to You shall be enumerated and displayed on the Maya XP page within the Maya app and across customer communications channels. The information displayed on the Maya XP page shall be deemed final and shall prevail over other communications and channels.

5.8. Benefits related to Maya’s lending products are still subject to Maya’s credit underwriting process and do not constitute any guarantees on issuance of credit.

5.9. Voucher Benefits provided may be subject to expiry and additional terms and conditions as stated on the voucher.

5.10. Benefits provided by third-party suppliers and Merchants will be subject to the Terms and Conditions of the partner. Any dispute or issue arising from the use of Merchant Benefits shall be resolved directly between the customer and the merchant, subject to the merchant’s applicable policies.

5.11. Maya may change, cancel, substitute, discontinue, or set new conditions on rewards, privileges, benefits, or any part of the Program at its discretion, including but not limited to those listed below:

5.11.1. Program partners, Merchants, Affiliates, or participating organizations;

5.11.2. The structure and eligibility to participate and redeem rewards;

5.11.3. Features of special offers and promotions. Customer will be notified if there is any cancellation, discontinuance, amendment, change, or substitution relating to a reward, privilege, or benefit. The provision of rewards, privileges, or benefits from Program partners is subject to the continued participation of partners.

5.12. If the Program or an existing Maya account is terminated, the Customer will lose eligibility to redeem any benefits tied to their Level. Except for data governed by Anti-Money Laundering regulations or other legal requirements, all Program-related data will be retained for a period of two (2) years.

6. Data Privacy

6.1. The Customer agrees and accepts the Privacy Policy and Data Privacy Statement of Maya found in this site: https://www.maya.ph/privacy.

7. Termination & Suspension

7.1. Maya reserves the right to: (i) discontinue the customer’s eligibility to the Program; (ii) cancel, change, or substitute any service, privilege, or benefit extended; (iii) amend, modify, or supplement these Terms and Conditions; or (iv) suspend or terminate the Program provided that Maya notifies customers of the changes a minimum of 30 days ahead of time.

7.2. Maya shall not be responsible or liable in any manner whatsoever for any costs, losses, damages, expenses, or other consequences caused by the exercise of the foregoing rights. Neither will Maya be liable for any special, consequential, exemplary, or indirect damages for any loss of value, opportunities, or benefits that may arise as a result of any of the foregoing or changes made to the Program.

7.3. Maya may amend from time to time any or all of the eligibility criteria of the Program. Any amendments to the eligibility criteria shall be published on the website or in any other manner deemed appropriate by Maya.

7.4. Termination of the program will also lead to the termination of the benefits associated with the customer’s Level. Customers will be entitled to the benefits issued to the them until the validity of the benefit is set to expire or be refreshed.
